Acceptance of the general conditions of sale and conclusion of the contract:

The contract stipulated between Tacchettee.it and the Customer (i.e. the individual, natural person, who makes the purchase on the Site, not referable to his commercial, entrepreneurial or professional activity) must be considered concluded with the acceptance, even if only partial, of the order from Tacchettee.it. In the event of non-acceptance of the order, Tacchettee.it will in any case promptly notify the Customer.

By placing an order in the various ways provided, according to the order form on the Site (hereinafter the "Order"), the Customer declares to have read all the information provided to him during the purchase procedure and to fully accept these general conditions (hereinafter the “Conditions”).

These Conditions may be printed or saved on a durable medium, in compliance with the provisions of the art. 12 of Legislative Decree 70/2003 and art. 51 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014.

The products offered for sale by Tacchettee are only those present on the Tacchettee.it website at the time the Order is placed, as described in the relevant information sheets.

In any case, it is understood that the images accompanying the description of a product are for informational purposes only and may not be perfectly representative of its characteristics but may differ, for example. by color and size (also based on the browser and monitor used to access the Site and view the images).

To place an Order, the Customer must complete the relevant form on the Site in its entirety and send it after having carefully read the Conditions, as well as the characteristics of the product and/or products he intends to purchase. The Customer must also request Tacchettee.it, where desired, to issue a tax invoice relating to the purchase, pursuant to art. 22 Presidential Decree no. 633/1972.

The correct receipt of the Order is confirmed by Tacchettee.it through a response via e-mail, sent to the e-mail address communicated by the Customer. This confirmation message will summarize the purchase conditions, as required by applicable law, as well as the data entered in the Order by the Customer, so that the Customer can verify the same and possibly communicate the necessary corrections of incorrect data without delay.

The prices indicated on the site are to be considered inclusive of taxes and VAT. Any shipping costs or payment costs are in any case communicated in advance to the Customer through the site or these Conditions.

The purchased products will be delivered to the address indicated by the Customer in the Order within 10 working days from the date of registration of the Order by Tacchettee.it, at the cost specifically indicated on the Site before sending the Order. Tacchettee.it reserves the right to accept or not accept deliveries requested outside Italian or European borders. In any case, for deliveries to be carried out outside Italian borders, shipping costs and delivery times may vary.

With regards to deliveries requested in countries not belonging to the European Union, any import customs costs will be borne by the recipient. The Customer is therefore invited to contact the customs authorities of their country in advance to verify the costs and any import limits.

The delivery times indicated by Tacchettee.it must be considered purely indicative and a delay compared to them, or any delivery made with subsequent split shipments does not entitle the Customer to refuse the delivery itself and to request compensation or compensation.

Upon delivery of the products, the Customer is required to check:

• that the number of packages delivered corresponds to what is indicated in the transport document.
• that the packaging is intact, not damaged, wet or otherwise altered, including the closing materials.

Any damage to the packaging and/or to the product or the mismatch in the number of packages or indications must be immediately detected by placing a specific indication on the delivery document of the product to be returned to the courier.

Any problems relating to the physical integrity, correspondence or completeness of the products received must be reported within 10 days of delivery, according to the methods set out in this document.

Pursuant to art. 52 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, the Customer may withdraw from the Conditions and therefore from the purchase contract for any reason, without the need to provide reasons and without any penalty, within 100 (one hundred) working days from the date of receipt of the products.

To exercise the right of withdrawal referred to in the previous article 5.1, the Customer must send a communication to this effect to Tacchettee.it, within the terms indicated, using the appropriate form on the Site.

In case of withdrawal, the Customer must return the products to our warehouses within 100 (one hundred) days of the withdrawal itself, by contacting Tacchettee.it through the appropriate Returns Portal on the site

The goods must be returned intact, complete with all their parts and in the original packaging (envelopes and packages), kept and possibly used for the time strictly necessary to establish and verify their nature, characteristics and size, according to normal diligence, without are signs of wear or dirt, in compliance with the following conditions:

• the right of withdrawal may apply to the product purchased in its entirety; in fact, it is not possible to exercise withdrawal only on part of the purchased product (e.g. accessories, complements, etc.);
• for withdrawal to be possible, the product must be intact and returned in the original packaging, complete in all its parts (including packaging and any documentation and accessories;
• the shipment, until receipt is certified in the warehouse indicated by Tacchettee.it, is under the complete responsibility of the customer;
• in the event of damage to the goods during transport, Tacchettee.it will notify the Customer, to allow him to promptly file a complaint against the courier he has chosen and obtain the relevant reimbursement; the product will then be made available to the Customer, simultaneously canceling the withdrawal request;
• Tacchettee.it will not be liable in any way for damage, theft or loss occurring during or in any case in connection with the return shipment.

Tacchettee.it will refund the Customer the entire amount already paid net of shipping costs pursuant to art. 56, paragraph 2, of Legislative Decree 21/14, within 14 (fourteen) days of withdrawal, through a cancellation procedure of the debited amount, using the same payment method used by the Customer for the initial transaction, unless otherwise agreed and at net of shipping costs for sending the package whether they were borne by the customer or the seller.

Tacchettee.it may suspend the refund until receipt of the returned product or until the Customer demonstrates that he has correctly sent the product back, whichever is earlier.

In any case, the Customer will lose the right of withdrawal in cases where Tacchettee.it ascertains that:

• the returned product and/or its accessories, and/or its packaging are not intact;
• the product is missing its external packaging and/or the original internal packaging;
• the product is missing integral elements and/or accessories.

In the event of forfeiture of the right of withdrawal, Tacchettee.it will return the purchased product to the sender, charging the shipping costs and, if already refunded, the price of the product.

WARRANTY

All products sold by Tacchettee.it are covered by a 24 (twenty-four) month warranty for defects of conformity, pursuant to Title III of the Legislative Decree. 206/2005. To benefit from warranty assistance, the Customer must keep the invoice, or the payment receipt, together with the transport document.

In the event that, for any reason, Tacchettee.it is unable to return a product under warranty to the Customer (restored or replaced), or if the repair or replacement is excessively expensive, also due to the value of the product, Tacchettee.it may proceed with the appropriate reduction of the price paid, or rather with the refund of the entire amount paid with termination of the contract.

In cases where the application of the guarantees requires the return of the product, the same must be returned by the Customer in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment).

PRIVACY

The personal data collected when placing the Order will be processed by Tacchettee.it for the sole purpose of satisfying the express requests of the Customer, in compliance with EU 2016/679 and the privacy information on the site. Any further processing will be carried out only with the express consent of the Customer.

APPLICABLE LAW

The sales contract referred to in these Conditions and its execution is governed by Italian law, with the non-application of conflict rules and the United Nations Convention for the International Sale of Goods. The Court of the municipality of residence of the Customer will be competent to resolve the related disputes.

AGREEMENT

The contract replaces all previous contracts, agreements and understandings between the parties and constitutes the entire agreement between the parties regarding the subject matter of the contract, together with the order, the general conditions relating to the use of the site and the conditions relating to the registration service. Any variation or modification of the contract must be accepted in writing by both parties.

COMMUNICATIONS

All communications between the parties must be made in writing and sent to the other party's address indicated in the contract and in the order. Communications sent to the other party's email address, indicated on the site and in the order, are also considered to be sent in writing.

Communications relating to the validity or existence of this agreement must be exclusively delivered by hand or sent by registered letter with acknowledgment of receipt.
